(2) On 20 December the Commission approved a draft Regulation on modifications to the Staff Regulations and implementing rules for appraisal and promotion with a view to submitting them to the inter-institutional Staff Regulations Committee for an opinion.

1. The general provisions implementing these Staff Regulations shall be adopted by the appointing authority of each institution after consulting the Staff Committee and the Staff Regulations Committee.

It should be noted, moreover, that the criteria required of candidates who were staff from the national diplomatic services of the Member States, in paragraph 2 of the second group of eligibility criteria, namely that they should have a level of education which corresponds to completed university studies of at least three years attested by a diploma, matches the criterion required in Article 5(3)(b)(i) of the Staff Regulations for appointment at grades 5 and 6 in the administrators’ function group (AD), a criterion which is very diffe ...[+++]rent from that required by Article 5(3)(c) of the Staff Regulations for appointment at grades 7 to 16 in the same function group.

Moreover, the argument that, if the position in question has already been filled when the action is brought, an unsuccessful candidate’s application for annulment of the decision rejecting his application will be admissible only if he also seeks annulment of the decision to appoint another candidate to that position would have the effect of introducing a condition for the admissibility of actions concerning the legality of acts adversely affecting officials brought under Article 90(2) of the Staff Regulations which is not laid down in those regulations: there is no requirement under Article 91 of the Staff Regulations (which relates to a ...[+++]ctions brought by officials before the Courts of the European Union against acts adversely affecting them) or indeed in any other legislation, that, in order for his action to be admissible, a candidate who has been unsuccessful in a selection procedure must necessarily direct that action against both the decision rejecting his application and the corresponding decision to appoint another candidate.
