Les deuxième et troisième moyens, tirés, respectivement, d’une violation de l’article 1 , paragraphe 4, de la position commune 2001/931 et d’une erreur de droit commise dans l’appréciation des principes relatifs au droit à une protection juridictionnelle effective, sont dirigés contre la seconde partie de l’arrêt attaqué dans laquelle le Tribunal a examiné et jugé fondés les deuxième et troisième moyens avancés devant lui par la PMOI.
The second and third grounds of appeal, claiming breach of Article 1(4) of Common Position 2001/931 and an error of law in the assessment of the principles relating to the right to effective judicial protection, respectively, are directed against the second part of the judgment under appeal in which the General Court examined, and held well founded, the second and third pleas in law put before it by the PMOI.
