The monitoring scheme established by Decision No 3052/95/EC of the European Parliament and of the Council of 13 December 1995 establishing a procedure for the exchange of information on national measures derogating from the principle of the free movement of goods within the Community (13) has proved largely unsuccessful in that its implementation has not provided the Commission with sufficient information to identify sectors where harmonisation might be appropriate. Nor has it brought about a rapid resolution of certain free-movement problems.

The Court therefore concludes that the principle of freedom to provide services laid down in the EC Treaty, read in the light of the fundamental right to respect for family life, precludes a refusal, by the Member State of origin of a provider of services established in that Member State who provides services to recipients established in other Member States, of the right to reside in its territory to that provider's spouse, who is a national of a third country.

A national of a Member State established in that State, who carries on a cross-border business providing services, may rely on Community law for the purpose of enabling his spouse, who is a national of a third country, to obtain a right to reside in that State.
