B. considerando che al-Rahim al-Nashiri è stato detenuto nelle carceri americane per quasi nove anni e che, nonostante il suo nome figuri su un atto di incriminazione presentato a un tribunale federale USA solo pochi mesi dopo il suo arresto avvenuto nel 2002, non è stato portato subito dinanzi al giudice e processato senza ingiustificati ritardi, come prescritto dal diritto internazionale, ma è stato tenuto in custodia segreta fino al trasferimento a Guantanamo nel 2006,
B. whereas al-Rahim al-Nashiri has been in US custody for nearly nine years, and whereas, despite being named in an indictment submitted to a US federal court only months after his arrest in 2002, he was not brought promptly before a judicial authority and brought to trial without undue delay, as required by international law, and was instead detained in secret until being transferred to Guantánamo in 2006,
