La Corte di giustizia delle Comunità europee (di seguito «Corte di giustizia») (1) ha stabilito che la partecipazione degli Stati membri alla CPPNM è compatibile con le disposizioni del trattato Euratom soltanto a condizione che, per i settori di sua competenza, la Comunità partecipi in quanto tale alla convenzione, a fianco degli Stati membri e che alcuni obblighi previsti dalla convenzione possono essere posti in vigore, per quanto riguarda la Comunità, soltanto grazie ad una stretta associazione, tanto nel processo di negoziazione e di stipulazione quanto nell'adempimento degli impegni assunti, fra la Comunità e gli Stati membri.
