Le differenze in merito alla struttura e all’organizzazione dei sistemi dei registri pubblici nel settore della proprietà immobiliare, come pure le differenze concernenti la natura e le dimensioni delle fede pubblica loro attribuita, impongono l’esclusione dal settore del diritto immobiliare di un futuro strumento comunitario, in presenza della stretta correlazione fra le modalità di stesura di un atto autentico, da un lato, e l’iscrizione nel registro pubblico, dall’altro.
Differences in the structure and organisation of public registry systems in the field of property ownership, as well as differences concerning the nature and scale of the public confidence placed in them, mean that the field of property law has to be excluded from a future Community instrument, given the close correlation between the method of drawing up an authentic act and entry into the public register.
