Secondo la Convenzione, nel caso in cui il condannato divenga oggetto di una revoca della condizionale, o perché sottoposto a procedimento penale o a condanna per un nuovo reato, ovvero perché inadempiente agli obblighi impostigli, lo Stato richiedente è il solo competente a giudicare, tenuto conto delle informazioni e dei pareri forniti dallo Stato richiesto, se il reo ha adempiuto o meno gli obblighi che gli erano stati imposti e, sulla base di tale valutazione, ad adottare ulteriori misure previste dalla propria legislazione (artt. 13 e 15 della convenzione).
Under the Convention, where there is a risk that the conditional release decision might be withdrawn, because the offender has either re-offended or breached the obligations imposed on him, the requesting State alone has jurisdiction to judge, on the basis of the information and comments supplied by the requested State, whether or not the offender has satisfied the conditions imposed upon him, and, on the basis of such appraisal, to take any further steps provided for by its own legislation (Articles 13 and 15 of the Convention).
