In deroga al punto 1.1., durante la fase III B, ma per non più di tre anni dall'inizio di detta fase, ad eccezione dei motori destinati alla propulsione di locomotive e automotrici ferroviarie, l'OEM che intenda far ricorso al regime di flessibilità chiede a qualsiasi autorità di omologazione che i propri fabbricanti di motori siano autorizzati a immettere sul mercato motori ad uso esclusivo dell'OEM.
1.2 By way of derogation from point 1.1, during Stage III B, but no longer than three years after the beginning of that Stage, with the exception of engines for use in propulsion of railcars and locomotives, an OEM that wishes to make use of the flexibility scheme shall request permission from any approval authority for the OEM’s engine manufacturers to place on the market engines intended for the OEM’s exclusive use.
