The existing national legislation and regulations in the area covered by the proposal are marked by disparities and shortcomings as a result of which the level of protection for workers varies significantly between Member States, as do the burdens placed on companies by the measures imposed. This situation has persisted for a considerable length of time and no spontaneous movement towards a remedy has been observed, with the exception of noise, where the aforementioned Directive 86/188/EEC has acted as a Community basis for protective measures.
