ome correttamente rilevato dalla Commissione nelle proprie memorie, numerosi atti comunitari sono stati, infatti, adottati sul fondamento dell’art. 133 CE o, precedentemente, sul fondamento dell’art. 113 del Trattato CE (divenuto, in seguito a modifica, art. 133 CE), sebbene avessero proprio la finalità di limitare, o addirittura di impedire completamente, le importazioni o le esportazioni di taluni prodotti (a tal proposito v., in particolare, sentenze 17 ottobre 1995, causa C‑70/94, Werner,
Racc. pag. I‑3189, punto 10; causa C‑83/94, ...[+++] Leifer, Racc. pag. I‑3231, punto 10, e 14 gennaio 1997, causa C‑124/95, Centro‑Com, Racc. pag. I‑81, punto 26).
As the Commission has rightly pointed out in its written submissions, numerous Community measures have been adopted on the basis of Article 133 EC or, previously, Article 113 of the EC Treaty (now, after amendment, Article 133 EC), even though they were explicitly designed to restrict, or indeed prohibit entirely, imports or exports of certain products (see, in that connection, in particular, Case C-70/94 Werner [1995] ECR I-3189, paragraph 10; Case C-83/94 Leifer [1995] ECR I-3231, paragraph 10; and Case C‑124/95 Centro-Com [1997] ECR I-81, paragraph 26).
