Fatti salvi i contratti di diritto privato gli Stati membri dovrebbero assicurare che i creditori non possano risolvere un contratto di credito a motivo del fatto che, dopo la firma del contratto stesso, si sono resi conto che la valutazione del merito di credito era stata condotta scorrettamente a causa di informazioni incomplete all’epoca della valutazione.
Without prejudice to private contract law, Member States should ensure that creditors cannot terminate a credit agreement because they realised, after the signature of the credit agreement, that the assessment of creditworthiness was incorrectly conducted due to incomplete information at the time of the creditworthiness assessment.
