Innanzi tutto essa riafferma in modo netto i diritti civici fondamentali contenuti nella Convenzione europea dei diritti umani. A tale titolo, i redattori della Carta si sono costantemente preoccupati di evitare qualunque increscioso rischio di discrepanza nella giurisprudenza tra Corte europea dei diritti umani, responsabile del rispetto della Convenzione, e Corte di giustizia delle Comunità europee, segnatamente riprendendo il testo della Convenzione del Consiglio d’Europa ogni qual volta esso offrisse la soluzione più completa e più attuale.
First and foremost, it unambiguously reaffirms the fundamental civil rights set out in the European Convention on Human Rights and, on this account, those who drafted the Charter took great care to avoid any possibility of a regrettable divergence in judicial practice between the European Court of Human Rights, which is responsible for ensuring compliance with the Convention, and the Court of Justice of the European Communities, particularly by incorporating the wording of the Council of Europe’s Convention every time that this appeared to be the most well-rounded and pertinent option.
