In entrambi i casi, che il lavoratore svolga o no abitualmente il proprio lavoro in uno stesso paese, il collegamento oggettivo definito dalla convenzione può essere disapplicato mediante una clausola d'eccezione (articolo 6, paragrafo 2, in fine), la quale permette in tal modo di evitare le conseguenze pregiudizievoli per il lavoratore di un rigido assoggettamento del contratto alla legge del luogo di esecuzione [78].
In both cases, whether or not the worker habitually carries out his work in the same country, the objective connection defined by the Convention can be overridden by an exception clause (end of Article (2)), which for the worker avoids the harmful consequences of rigid connection of the contract to the law of the place of performance.
