The notion of serious offences against the common system of value added tax (‘VAT’) as established by Council Directive 2006/112/EC (the ‘common VAT system’) refers to the most serious forms of VAT fraud, in particular carrousel fraud, VAT fraud through missing traders, and VAT fraud committed within a criminal organisation, which create serious threats to the common VAT system and thus to the Union budget.

Proceeds from criminal activities such as Value Added Tax (VAT) fraud, Missing Trader Intra Community (MTIC) fraud and Money Laundering have been reinvested in the United Arab Emirates and key criminals involved in these frauds have sought refuge there.

With this new proposal, the Commission wants to tackle specific cross-border related issues such as the increasing occurrence of missing-trader fraud and the deliberate abuse of the VAT system by criminal gangs who set up such schemes to take advantage of the failures in the system.

140. Considers that VAT fraud, and in particular the so-called carousel or missing trader fraud, distorts competition, and deprives national budgets from significant resources and is detrimental to the Union budget; calls on the Commission to use all means to enforce the obligation of Member States to provide information in a timely manner to the Commission; welcomes in this regard the promise of the Commissioner to provide Parliament until 1 May 2014 with an overview of the developments of the initiatives taken to tackle tax evasion and avoidance taking place within the Union and in relation to third countries;
