Tale impresa ha fatto valere che il divieto di licenziamento di una lavoratrice gestante previsto dal diritto comunitario non si applica ad una dipendente assunta a tempo determinato che, pur sapendo di essere in stato interessante al momento della conclusione del contratto di lavoro, abbia omesso di informarne il datore di lavoro e che, avendo diritto al congedo di maternità, non avrebbe potuto svolgere, per una gran parte della durata del detto contratto, l'attività lavorativa per la quale essa è stata assunta.
Tele Danmark considers that the prohibition under Community law of dismissing a pregnant worker does not apply to a worker, recruited on a temporary basis, who, despite knowing that she was pregnant when the contract of employment was concluded, failed to inform the employer of this, and because of her right to maternity leave was unable, for a substantial part of the term of that contract, to do the work for which she had been recruited.
