Quando una società svolge la propria attività sul territorio dello Stato membro in cui ha sede, il fatto che le sue scelte gestionali siano o possano essere controllate da una società madre stabilita in un altro Stato membro non è sufficiente per superare la presunzione legata al luogo della sede statutaria.
