La decisione entra in vigore solo dopo l'istituzione del sistema giudiziario, cioè alla data della pubblicazione nella Gazzetta ufficiale dell'Unione europea della dichiarazione del presidente della Corte di giustizia che il Tribunale del brevetto comunitario e la giurisdizione d'appello presso il Tribunale di primo grado sono stati costituiti conformemente alla legge.
