The presumption in the Criminal Code provides that the blood alcohol reading at the time of the test, a test properly done, is deemed to be the same as at the time of driving where that test is conducted within a two-hour period, thus avoiding the need to call a toxicologist to court to extrapolate back what would have been the reading at precisely the time of driving.
