Secondly, the Commission doubted that the Region had acted as a market economy investor when it set up Fluorite di Silius, in order to have it bid for the mining concession, on the basis of a business plan with an internal rate of return of 3,5 % (9), which was clearly below the average for the industry (10), and below the opportunity cost to the investor measured by reference to State bonds (11).

Le plan industriel prévoyait en effet un taux de rentabilité interne de 3,5 % (9), ce qui est clairement inférieur à la moyenne du secteur (10) ainsi qu’au coût d’opportunité pour l’investisseur mesuré sur la base des bons du Trésor (11).
