the conditions in which the machinery meets the requirement of stability during use, transportation, assembly, dismantling when out of service, testing or foreseeable breakdowns.

Machinery must be designed and constructed in such a way that the stability required by section 1.3.1 is maintained both in service and out of service, including all stages of transportation, assembly and dismantling, during foreseeable component failures and also during the tests carried out in accordance with the instruction handbook.

These tests range from tests based on the country of residence of the investor, through solicitation tests to "characteristic performance" (based on an assessment of where the intermediary employs the resources for carrying out the service).
