5. The current EU rules on public procurement already contain provisions on abnormally low tenders. These provisions give contracting authorities the power, after having verified the constituent elements of the tender, to reject the tender if they consider that there are no sufficient guarantees that the tenderer will perform the contract according to the terms offered.
