The Commission adds that even if the part of the action relating to access to information were held to be admissible, since a right of access to the procedural documents of a competition may exist independently of an application for annulment of a decision of a selection board, the claim relating to non-admission to the oral test, which is the main part of the action, would still be inadmissible.
La Commission ajoute que même si la partie du recours relative à l’accès aux informations était jugée recevable, dans la mesure où un droit d’accès aux documents de la procédure d’un concours peut exister indépendamment d’une demande d’annulation d’une décision du jury du concours, la prétention relative à la non-admission à participer à l’épreuve orale, qui serait la partie principale du recours, resterait irrecevable.
