By the fifth part of its plea, Procter Gamble submits that the public’s habit of perceiving the shape and pattern of a tablet as indicative of a product’s origin, a habit which may be created by the use of, or advertising for, other signs, is within the ambit of Article 7(1)(b) of Regulation 40/94 and not that of Article 7(3) of the regulation.
Par la cinquième branche du moyen, Procter Gamble soutient que l’habitude générale qu’a le public de percevoir la forme et le dessin d’une tablette comme indiquant l’origine d’un produit, habitude qui peut être créée par l’usage d’autres signes ou par la publicité faite pour ces signes, relèverait de l’article 7, paragraphe 1, sous b), du règlement n° 40/94 et non du paragraphe 3 de cet article.
