I could point to one example in the Criminal Code where we did have something that impacted upon the provinces: the curative treatment discharge under subsection 255(5), where it was differentially proclaimed.

The final point and my final comment here is that the Criminal Code currently allows the courts to discharge an impaired driver who is in need of curative treatment by placing that person on probation with a condition that he or she attend such treatment.
