There is a confusion in the Common Position concerning the categorisation of convertible bonds and warrants, since in Article 2.1 (b) of the Common Position, convertible bonds and warrants where the underlying shares are shares of the issuer are defined as "equity securities", whereas Recital 12 refers to convertible bonds as "non-equity securities".
