Where it has found that there is restructuring of the bargaining unit involved or restructuring takes place, one company buys another and the employees are then amalgamated and intermingled, as it says in the current code, the board can receive an application to reopen the collective agreement ahead of its scheduled expiry date, and right now the board will consider that application, and one of the things it will consider is whether the provisions of the collective agreement regarding seniority have been handled fairly.
Aux termes de la procédure actuelle, si le Conseil constate qu'il y a effectivement restructuration de l'unité de négociation, qu'il y a amalgame des équipes de travailleurs parce l'entreprise en a acheté une autre, il peut recevoir une demande de réouverture de la convention collective avant même que celle-ci arrive à échéance. Dans ce cas, le Conseil prendra la demande en considération et il vérifiera, entre autres choses, si on a respecté les dispositions des conventions collectives relativement à l'ancienneté.
