Article 25 of the Transfer of Prisoners in conjunction with Article 4(6) and 5(3) of the European arrest warrant allows a Member State to refuse to surrender a person under a European arrest warrant (or allow for a surrender under the condition that the person has to be returned to that Member State) where the requested person is a national, a resident or is staying in that Member State if that Member State undertakes to enforce the prison sentence in accordance with the Transfer of Prisoners.
