Les discussions peuvent très bien s'être déroulées dans le cadre d'une constellation d'alliances mouvantes et même avoir servi de tribune à des menaces de représailles ou d'hostilités mais, en s'inscrivant dans le processus évolutif d'arrangements et d'accords partiels ayant pour but la fixation des prix, la coordination des augmentations de prix ainsi que la répartition des marchés et parts de marchés, elles ont constitué un comportement d'entente interdit par l'article 85, paragraphe 1.
The discussions may have involved a shifting constellation of alliances, even threats of reprisal or hostile action, but as part of the developing process of understandings and partial agreements intended to fix prices, coordinate price increases and allocate markets and market shares they constituted cartel conduct prohibited by Article 85(1).
