Sans préjudice de l'article 23 de la partie II du protocole 3 de l'accord Surveillance et Cour de justice et de la possibilité d'une action devant la Cour AELE, conformément à l'article 1, paragraphe 2, deuxième alinéa, de la partie I du protocole 3 de l'accord Surveillance et Cour de justice, l'autorité engagera la procédure prévue à l'article 1, paragraphe 2, de la partie I du protocole 3 de l'accord Surveillance et Cour de justice si l'État AELE omet de communiquer:
Without prejudice to Article 23 in Part II of Protocol 3 to the Surveillance and Court Agreement and to the possibility of an action before the EFTA Court, in accordance with the second subparagraph of Article 1(2) in Part I of Protocol 3 to the Surveillance and Court Agreement, the Authority will initiate proceedings under Article 1(2) in Part I of Protocol 3 to the Surveillance and Court Agreement if the EFTA State fails to communicate:
