(22) While it is laid down that the tasks do not concern, among others, ' regulatory powers' , which may have different legal consequences in different Member States, it should nevertheless be specified that an EGTC's assembly may, if the EGTC Convention specifically so provides, and, in compliance with national and Union law, define the terms and conditions of the use of an item of infrastructure the EGTC is managing, or the terms and conditions according to which a service of general economic interest can be provided including the tariffs and fees to be paid by the users.

Le Comité des régions a identifié un certain nombre de problèmes, dont votre rapporteur se fait l'écho, notamment : la clarification du statut des GECT dans les systèmes juridiques des États membres, l'autorisation de la création de GECT entre des acteurs situés dans un État membre et un État non membre, la reformulation de l'article 4, paragraphe 3, pour que le délai de trois mois (dans lequel l'État membre marque son accord ou son désaccord à la création du GECT) soit respecté de manière stricte et une simplification du droit régissant le personnel et le régime fiscal des GECT.

Your rapporteur would like to join with the Committee of the Regions in drawing attention to a number of problems: the need to clarify the status of EGTCs under the legal systems of the Member States, problems in securing authorisation to establish EGTCs involving actors situated in a Member State and a country outside the EU, the need to reword Article 4(3) in order to ensure that the three-month time limit within which Member States must approve or otherwise the establishment of an EGTC is strictly complied with and a simplification of the legal provisions governing the staff of and tax arrangements for EGTCs.
