1. Chaque État membre peut notifier au secrétariat général du Conseil que, dans ses relations avec d'autres États membres qui ont procédé à la même notification, le consentement est réputé avoir été donné pour qu'une personne soit poursuivie, condamnée ou détenue en vue de l'exécution d'une peine ou d'une mesure de sûreté privatives de liberté, pour une infraction commise avant sa remise, autre que celle qui a motivé sa remise, sauf si, dans un cas particulier, l'autorité judiciaire d'exécution en dispose autrement dans sa décision statuant sur la remise.
1. Each Member State may notify the General Secretariat of the Council that, in its relations with other Member States that have given the same notification, consent is presumed to have been given for the prosecution, sentencing or detention with a view to the carrying out of a custodial sentence or detention order for an offence committed prior to his or her surrender, other than that for which he or she was surrendered, unless in a particular case the executing judicial authority states otherwise in its decision on surrender.
