La «prestation caractéristique » est celle qui permet de distinguer un contrat d'un autre (par exemple, l'obligation du vendeur de transférer la propriété, dans le contrat de vente; celle du transporteur de transporter un bien ou une personne, dans le contrat de transport, etc.); l'obligation de payer une somme d'argent ne constitue donc pas, sauf exception, la prestation caractéristique au sens de l'article 4.
The "characteristic performance" is what makes it possible to distinguish one contract from another (e.g. the obligation of the vendor to transfer the property, in a sales contract; the obligation of a carrier to transport a good or a person, in a contract of carriage; etc.); the obligation to pay an amount of money does not therefore constitute the characteristic performance for the purposes of Article 4, though there may be exceptions.
