L'astreinte journalière est déterminée par le calcul quotidien d'intérêts sur le montant dû selon le taux appliqué par la Banque centrale européenne à ses opérations principales de refinancement, tel qu'il est publié au Journal officiel de l'Union européenne, série C, en vigueur le premier jour civil du mois de l'échéance, majoré de 8 points de pourcentage, à compter de la date à laquelle le montant était exigible.
The daily penalty interest shall accrue on a daily basis on the amount due at an interest rate applied by the European Central Bank to its principal refinancing operations, as published in the C series of the Official Journal of the European Union, in force on the first calendar day of the month in which the payment deadline falls increased by 8 percentage points from the date on which the instalment was due.
