It is my understanding that under the Public Service Superannuation Act, the Canadian Forces Superannuation Act and the RCMP Superannuation Act there is a discretion in Treasury Board, generally, that, after 12 months of living together, so long as that is immediately before death, if the pension holder has resided with a member of the opposite sex and there has been a public representation of that person as a spouse, then that person can be a surviving annuitant.
