Toutefois, selon la jurisprudence constante de la Cour de justice des Communautés européennes, toute restriction à la libre prestation de services doit, comme toutes les dérogations à un principe fondamental du traité, être interprétée de manière restrictive, en ce qui concerne notamment la protection des mineurs et de la santé, pour autant que le contrôle a priori des idées ou des opinions ne soit en aucune circonstance permis.
