1. 2. Notwithstanding Article 5(a) of the basic Regulation, a Member State may become responsible for the cost of benefits in accordance with Article 22 of the basic Regulation only if, either the insured person has made a claim for a pension under the legislation of that Member State, or in accordance with Articles 23 to 30 of the basic Regulation, he receives a pension under the legislation of that Member State.

In the light of the foregoing, and in accordance with Article 15 of the basic Regulation, definitive countervailing duties should be imposed in accordance with the lesser duty rule in Article 15(1) of the basic Regulation.
