Because of the approach adopted in the Commission proposal, if the Council were to refuse to adopt the decision, Canary Islands firms and producers, which since 1 January 2002 have been benefiting from exemptions under Law 24/2001, would have to pay the tax from which they had been exempted. The Commission would be entitled to institute infringement proceedings because State aid of a fiscal nature would, in that event, have been granted in error.
