(2) Par dérogation au paragraphe (1), les bâtiments et ouvrages érigés à la surface des terres en vertu d’une entente avec le propriétaire des droits superficiaires et utilisés dans le cours des travaux généraux du locataire dans la région, sans être en rapport direct avec les ouvertures sur les terres, demeurent la propriété du locataire.
(2) Notwithstanding subsection (1), buildings and works erected on the surface of the lands under an agreement with the owner of the surface rights, and used in connection with the general operations of the Lessee in the area and not directly in connection with the openings in the said lands, shall remain the property of the Lessee.
