Il importe toutefois de souligner que, s'il était adopté, le traité constitutionnel constituerait pour l'Union européenne un cadre juridique nettement plus adéquat en matière de droit de l'enfant: l'article I-3 ("Les objectifs de l'Union") du traité constitutionnel contient des références directes aux droits de l'enfant et l'article 24 de la Charte des droits fondamentaux de l'Union européenne (qui a trait exclusivement aux droits de l'enfant) acquerrait de ce fait un caractère contraignant.
It should be stressed, however, that the Constitutional Treaty, were it to be approved, would give the European Union a far more adequate legal framework with regard to children's rights: Article I-3 of the Treaty on 'The Union's objectives', which contains direct references to children's rights and, in particular, Article 24 of the Charter of Fundamental Rights of the European Union (entirely devoted to the 'rights of the child') would become binding provisions.
