Al contrario, il fatto che nell'esame e nella determinazione della remunerazione dello Stato azionista si prenda costantemente in considerazione il pagamento delle imposte dovute da EDF allo Stato esattore, anche attraverso la regolarizzazione e l'estinzione dell'imposta non riscossa prima della legge n. 97-1026, tende a indicare che è lo Stato potere pubblico e non lo Stato investitore ad aver concesso l'esenzione d'imposta controversa.
Nevertheless, in their view, this evidence points to the existence of an investment decision. On the contrary, the fact that the payment of tax due by EDF to the state as revenue collector, including by the regularisation and discharge of the tax that had not been collected prior to Act No 97-1026, was constantly taken into account for the purposes of examining and setting the remuneration to the state as shareholder tends to indicate that the disputed tax exemption was adopted by the state acting as a public authority and not as an investor.
