Alla luce di tali obiettivi nonché del suo contesto complessivo e particolare, la Corte considera che la nozione di “soggiorno legale” che consente di acquisire il diritto di soggiorno permanente debba essere interpretata come soggiorno conforme alle condizioni enunciate da tale direttiva (vale a dire, essere lavoratore subordinato o autonomo nello Stato membro ospitante o disporre, per se stessi e per i propri familiari, di risorse sufficienti e di un’assicurazione malattia).
In the light of those objectives and the Directive’s overall and specific context, the Court considers that, for the purpose of the acquisition of a right of permanent residence, the term ‘legal residence’ must be construed as a period of residence which complies with the conditions laid down in the Directive (namely, the person concerned must be a worker or self-employed person in the host Member State or have sufficient resources and sickness insurance cover for himself and his family members).
