(a) 'Suspensory measures' are not 'sentences': as is stated in Article 2(e) they are obligations and instructions imposed in connection with a suspended sentence or a conditional sentence; (b) the replacement of 'all other judicial decisions' by 'all other subsequent decisions' is justified on the grounds of terminological consistency (see Articles 12, 14 and 15).

This is why it is so important that we should be unstinting in our efforts and should aim our arguments for the abolition of the death penalty at international fora and elsewhere.

These include the return of the death penalty; the tens of thousands of people who have disappeared in Lebanon; Lebanon’s adoption of the Rome Statute on which the International Criminal Court is founded; its adoption of the Geneva Convention Relating to the Status of Refugees; a solution to the issue of Palestinian refugees; and also certain individual cases of great concern to this House, such as that of the lawyer Mr Mughrabi, who is in prison today as a result of statements he actually made in this Chamber to Members of the European Parliament.

The demands contained in the rapporteur’s amendments – he talks of the protection of minorities, rightly demands the abolition of the death penalty and calls for a solution to the Kurdish problem – are in no way conditions designed to stand in the way of aid. Instead, they are valuable proposals for the necessary democratic reforms in Turkey.

We have all seen the horrendous pictures of the last death sentence passed by the Florida Court and it will therefore not surprise any of you that the first person to appear in the text of the joint resolution should be the Spanish – and hence European Union – citizen, Joaquín José Martínez, whose sentence we ask to be reviewed and whose death sentence we ask to be suspended.
