Per giurisprudenza costante, non spetta al giudice comunitario, nell’ambito del controllo di legittimità che esso esercita, rivolgere ingiunzioni alle istituzioni o sostituirsi a queste ultime (v., in particolare, sentenze del Tribunale 15 settembre 1998, cause riunite T-374/94, T-375/94, T‑384/94 e T‑388/94, European Night Services e a./Commissione, Racc. pag. II‑3141, punto 53, e 9 settembre 1999, causa T-127/98, UPS Europe/Commissione, Racc. pag. II‑2633, punto 50).
According to settled case‑law, the Community judicature is not entitled, when exercising judicial review of legality, to issue directions to the institutions or to assume the role assigned to them (see, inter alia, Joined Cases T‑374/94, T‑375/94, T‑384/94 and T‑388/94 European Night Services and Others v Commission [1998] ECR II‑3141, paragraph 53, and Case T‑127/98 UPS Europe v Commission [1999] ECR II‑2633, paragraph 50).
