La Corte conclude che una società stabilita in uno Stato del SEE e proprietaria di una nave battente bandiera di un paese terzo può avvalersi della libera prestazione dei servizi, quando effettua servizi di trasporto marittimo a partire da o verso uno Stato del SEE, a condizione che possa, in ragione del fatto che gestisce tale nave, essere qualificata come prestatore di servizi e che i destinatari di tali servizi siano stabiliti in Stati del SEE diversi da quello in cui la società è stabilita.
The Court finds that a company established in an EEA State which is proprietor of a vessel flying the flag of a third country may rely on the freedom to provide services where it provides maritime transport services from or to an EEA State, provided that it can, due to its operation of that vessel, be classed as the provider of those services and that the persons for whom the services are intended are established in EEA States other than that in which that company is established.
