Inoltre, una volta effettuata la scelta, nel giugno 2009, di notificare al ricorrente l’avviso di accertamento del 2009, l’autorità richiedente avrebbe potuto usufruire della possibilità prevista nella direttiva 2008/55, la direttiva in materia di assistenza reciproca in vigore all’epoca dei fatti, sia di ottenere dall’autorità adita ulteriori precisazioni sui dati di cui era in possesso riguardo all’indirizzo del ricorrente (articolo 4) sia di imporre all’autorità adita di notificare il credito al ricorrente (articolo 5).
