In due recenti sentenze riguardanti le elezioni europee, la causa Gibilterra (C-145/04, Spagna/Regno Unito ) e la causa Aruba (C-300/04, Eman en Sevinger ), la Corte di giustizia ha sottolineato un aspetto importante, cioè che, nonostante il margine di discrezionalità di cui godono gli Stati membri nel disciplinare gli aspetti della procedura elettorale del Parlamento europeo non armonizzati a livello di Unione, essi sono tenuti a rispettare i principi generali del diritto dell’Unione, sotto il controllo della Corte.
In two recent judgments connected with European elections, the Gibraltar case (C-145/04, Spain v. UK ) and the Aruba case (C-300/04, Eman en Sevinger ), the European Court of Justice made the important point that although the Member States have discretion in regulating those aspects of electoral procedure for the European Parliament (EP) elections which are not harmonised at EU level, they must respect general principles of EU law, under the control of the Court of Justice.
