In realtà, da alcuni punti di vista, i metodi descritti possono essere meno favorevoli per le imprese private rispetto a quelle pubbliche, poiché la registrazione della dichiarazione di restrizione del diritto di proprietà non esclude il rischio di realizzazione forzata e di estinzione dei diritti del legittimo successore ai beni del debitore.
In fact, in some aspects, the methods described may be less favourable for private undertakings compared to public ones, since the registration of declaration on the restriction of the right to ownership does not exclude the risk of execution proceedings/creditor’s or bankruptcy estate’s extinction of the rights of a legal successor to the debtor’s property.
