Dans l'arrêt Daihatsu Deutschland, précité, la Cour a dit pour droit que l'article 6 de la première directive doit être interprété en ce sens qu'il s'oppose à la législation d'un État membre qui n'ouvre qu'aux associés, aux créanciers ainsi qu'au conseil central des représentants du personnel ou au conseil des représentants du personnel de la société le droit de réclamer la sanction prévue par ce droit national en cas de non-respect par une société des obligations en matière de publicité des comptes annuels édictées par la première directive.
In Daihatsu Deutschland, cited above, the Court ruled that Article 6 of the First Directive was to be interpreted as precluding the legislation of a Member State from restricting to members or creditors of the company, the central works council or the company's works council the right to apply for imposition of the penalty provided for by the law of that Member State in the event of failure by a company to fulfil the obligations regarding disclosure of annual accounts laid down by the First Directive.
