S’agissant de la nécessité de sauvegarder la répartition des pouvoirs d’imposition et la sauvegarde des recettes fiscales, la Cour souligne que, dès lors qu’un État membre a choisi de ne pas imposer les fonds d’investissement résidents qui bénéficient de dividendes d’origine nationale, la nécessité d’assurer une répartition équilibrée du pouvoir d’imposition entre les États membres ne saurait être invoquée afin de justifier l’imposition des fonds d’investissement non-résidents bénéficiaires de tels revenus.
As regards the need to preserve the allocation of the power to tax and to safeguard tax revenue, the Court states that, where a Member State has chosen not to tax resident investment funds in receipt of nationally-sourced dividends, it cannot rely on the argument that there is a need to ensure a balanced allocation between the Member States of the power to tax in order to justify the taxation of non-resident investment funds in receipt of such income.
