A tal titolo rileva che, quando un soggetto passivo chiede in uno Stato membro la deduzione fiscale di donazioni effettuate a favore di enti stabiliti e riconosciuti di interesse generale in un altro Stato membro, a tali donazioni si applicano le disposizioni del Trattato relative alla libera circolazione dei capitali, ciò anche quando sono state eseguite in natura sotto forma di beni di uso corrente.
In that respect, it points out that, where a taxpayer claims, in a Member State, the deduction for tax purposes of gifts to bodies established and recognised as charitable in another Member State, such gifts come within the compass of the Treaty provisions on the free movement of capital, even if they are made in kind in the form of everyday consumer goods.
